Crimes against a person are divided into several categories in the Criminal Code of the Republic of Azerbaijan. These include crimes against life and health, crimes against constitutional rights and freedoms of a person and citizen, crimes against freedom, honor and dignity of a person, crimes against family and minors, crimes against sexual integrity and sexual freedom of the individual.

Crimes Against Life and Health

The most serious crime among crimes against life and health is the intentional killing of a person. Intentional killing, that is, intentionally killing another person’s life. According to article 120 of the Criminal Code, the person who committed this crime is punished with imprisonment for a term of fourteen years to twenty years or life imprisonment.

The Penal Code also provides liability for intentional killing by a mother of her newborn child during or immediately after birth.

A deliberate murder committed in a state of sudden strong emotional disturbance (affect) or intentional infliction of grievous or less serious harm to health in a state of sudden strong emotional disturbance caused by violence, a grave insult on the part of the victim or other illegal or immoral acts (inaction) of the victim, and equally a prolonged traumatic situation arises in connection with the systematic wrongful or immoral behavior of the victim. In these cases, the penalty is a fine or restriction of liberty.

A premeditated murder committed when exceeding the limits of necessary defense is punishable by correctional labor for a term of up to two years, or restriction of liberty for a term of up to two years, or imprisonment for a term of up to two years.

A deliberate murder committed when exceeding the measures necessary to detain a person who committed a crime is punishable by correctional labor for a term of up to two years, or restriction of liberty for a term of up to three years, or imprisonment for a term of up to three years.

Crimes against life and health also include murder committed through negligence, bringing to suicide, torture, euthanasia.

It should be noted that in many countries, euthanasia is not a criminal offense. The right to death, as well as the right to life, is guaranteed by law.

Repeated crime stipulated by article 120 of the Criminal Code shall be deemed repeated by a person who has previously committed one or more crimes provided for in articles of the Criminal Code establishing liability for intentional murder

Crimes Against Freedom and Dignity

Freedom and personal integrity of a person are guaranteed by the Constitution of the Republic of Azerbaijan. These rights may be restricted only in the manner prescribed by law.

Crimes against personal liberty and dignity include kidnapping, trafficking, forced labor, slander, abuse, illegal imprisonment and other crimes.

The abduction of a person is committed against two or more persons, against a woman in a state of pregnancy, a group of persons, a group of persons by prior conspiracy, organized by a group or criminal community (criminal organization), with the use of violence dangerous to life or health victim, with the use of weapons or objects used as weapons, from selfish motives or for hire.

A person who has voluntarily released the kidnapped is exempted from criminal liability unless his actions contain a different corpus delicti.

Persons committing slander and insulting honor and dignity are held liable under articles 147 and 148 of the Criminal Code.

Defamation, i.e. the dissemination of knowingly false information, discrediting the honor and dignity of another person; Insult, i.e. humiliating the honor and dignity of another person to others, bullying with the help of body movements, facial expressions, beating or paining the victim, writing letters, phone calls containing insults and other actions of this nature.

We also note that when confirming the correctness of the information disseminated, people who disseminate this news are exempted from criminal liability.

Crimes against minors and family relationships

Crimes against minors and family relationships are some of the most serious crimes. These crimes are committed by the parents of the minor or by any person legally responsible for raising a minor, or by a teacher or other employee of an educational, medical or other institution responsible for the custody of the minor.

Crimes of this category include the substitution of another person’s child in medical institutions, committed out of self-interest, revenge or other base motives by a person charged with the duty of protecting the child or caring for him, involving a minor in the commission of a crime by deception, promises, threats, committed by a person who has reached eighteen years of age, which are punishable by restriction of liberty, for a period provided by law.
