Work permits for foreigners and stateless persons

The increase in the activity of foreign and stateless persons into the labor market of the country increased the need for professional legal assistance for individuals and legal entities in this area.

Work permits for foreigners and stateless persons are issued through the legal entities that hire them, individuals engaged in entrepreneurial activities without forming a legal entity, as well as branches and representative offices of foreign legal entities.

Foreigners and stateless persons who have reached the age of 18 can work in Azerbaijan after receiving work permits from the legal entities that hire them, persons engaged in entrepreneurial activity, without creating a legal entity, branches and representative offices of foreign legal entities.

It should be noted that employers must enter into employment contracts with foreigners and stateless persons for the duration of their work permits and provide work only at the workplace. Thus, an employment contract for persons without a work permit is a serious offense.

Work permits are issued for a period of one year, and for a period of less than one year, work permits are issued for the same period. Work permits can be renewed at least once every year.

In article 3 of the Migration Code, the concept of “work permit” was given as follows: “work permit - a permit issued to foreigners and stateless persons in the manner established by this Code for engaging in paid work in the territory of the Republic of Azerbaijan”.

A work permit is an official document allowing foreigners and stateless persons to engage in paid work in the territory of the Republic of Azerbaijan.

Issuance of a work permit is carried out within the limits of the labor migration quota approved by the relevant executive authority. The procedure for establishing quotas for labor migration is approved by the relevant executive authority.

The quota is applied for the purpose of productive use of local labor resources and increase the effectiveness of measures in the field of regulation of labor migration processes. The quota is determined taking into account the state of the internal labor market, demand for labor, the availability of vacancies that are not claimed by a citizen of the Republic of Azerbaijan who has professional training and specialty that meets the requirements of the workplace, the ability to provide the employment service with the labor requirements of employers at the expense of local labor reserves, as well as the need to attract highly qualified foreign specialists.

What is migration?

International conventions on migration were adopted and the Republic of Azerbaijan ratified these conventions. One of them is the Convention on Migrant Workers of 1949.

The migration legislation of the Republic of Azerbaijan consists of the Constitution of the Republic of Azerbaijan, this Code, laws of the Republic of Azerbaijan, international treaties to which the Republic of Azerbaijan is a party, and other normative legal acts adopted in accordance with them.

As stated in Article 2 of the Migration Code, the migration legislation of the Republic of Azerbaijan is based on the principles of respect for human and civil rights and freedoms, legality, equality before the law and justice, ensuring the compliance of the migration legislation of the Republic of Azerbaijan with generally recognized norms of international law, applying innovative methods and ensuring transparency in regulation migration processes.
